Terms of Engagement – DIA Taxation

1. Authority to act

I authorise DIA Taxation and its authorised representatives to act on my behalf for the services I have requested. This may include communicating with the Australian Taxation Office, ASIC, ABR, state revenue offices, local councils, licensing bodies and other government agencies where required.

2. Information provided by client

I confirm that all information, documents and explanations I provide are true, complete and accurate. I understand that DIA Taxation will rely on the information provided by me and may not independently verify every document or transaction unless specifically engaged to do so.

3. Client identity verification

I understand that DIA Taxation may request identity documents before providing services or accessing my ATO records. The ATO says tax and BAS agents must verify a client’s identity before providing tax agent or BAS services.

4. Scope of services

DIA Taxation will provide only the services selected in this form or otherwise agreed in writing. Any additional work, advice, amendment, objection, audit response, bookkeeping, BAS, company registration, licence application or government correspondence may be quoted and charged separately.

5. Tax returns and lodgement

Where DIA Taxation prepares a tax return, BAS or other document, I must review the information carefully before lodgement. I understand that lodgement will only occur after I provide approval, and I remain responsible for the accuracy of the information submitted to the ATO or other government agency.

6. Tax debts, penalties and interest

I understand that any tax payable, ATO debt, penalty, interest charge or government fee remains my responsibility. DIA Taxation is not responsible for penalties, interest or delays caused by late, incomplete, false or misleading information provided by me.

7. Fees and payment

I agree to pay the fees quoted or agreed for the services requested. Government fees, ASIC fees, licence fees, ATO charges and third-party costs are separate unless clearly stated otherwise. DIA Taxation may require payment before commencing or lodging work.

8. Refunds

Payment of professional fees does not guarantee a tax refund, licence approval, company registration approval, ATO outcome or government decision. Refunds are not available for work already completed, unless required by law.

9. Communication

I agree that DIA Taxation may communicate with me by phone, SMS, email, online form, portal or other electronic method. I accept that electronic communication carries some risk and I must notify DIA Taxation immediately if my contact details change.

10. Privacy and confidentiality

DIA Taxation will handle my personal information for the purpose of providing tax, accounting, registration and related services. My information may be disclosed to the ATO, ASIC, ABR, government agencies, software providers or professional advisers where required to complete the service. Tax practitioners must generally keep client information confidential unless the client gives permission or there is a legal duty to disclose it.

11. Record keeping

I understand that I am responsible for keeping proper records, receipts, invoices, bank statements and supporting documents. DIA Taxation may request additional documents before finalising any tax return, BAS, application or advice.

12. No guarantee of outcome

DIA Taxation will use reasonable care and skill in providing services. However, DIA Taxation cannot guarantee any ATO refund, tax result, ASIC approval, licence approval, government processing time or third-party decision.

13. Termination of service

DIA Taxation may stop acting for me if I provide false or misleading information, fail to provide requested documents, fail to pay fees, behave inappropriately, or request work that may breach tax law, professional obligations or government requirements.

By ticking the acceptance box and submitting this form, I confirm that I have read, understood and accepted these Terms of Engagement.
